www.ec.gc.ca | The List of Toxic Substances in Schedule 1 of CEPA 1988 was "rolled over" and incorporated into Schedule 1 of CEPA 1999. It was determined that no assessment under section 64 of CEPA 1999 would be required, since all 26 substances met the criteria for "toxic" set out in that section.

The original 26 substances were regulated under the following:

1. Environment Contaminants Act
   It was deemed that the scientific basis of their negative effect on the environment and/or human life or health had been sufficiently demonstrated and that determination of their negative effect was consistent with the criteria set out in s.11 (a), (b) and/or (c) of CEPA 1988. Therefore, the Government of Canada, on the recommendation of the Ministers of Environment and Health, decided that no further assessment would be required under s.11 of CEPA 1988 and they would appear in Schedule 1 at the passage of CEPA 1999.
   
    
2. Clean Air Act
   It was deemed that the scientific basis of their negative effect on the environment and/or human life or health had been sufficiently demonstrated and that determination of their negative effect was consistent with the criteria set out in s.11 (a), (b) and/or (c) of CEPA 1988. Therefore, the Government of Canada, on the recommendation of the Ministers of Environment and Health, decided that no further assessment would be required under s.11 of CEPA 1988 and they would appear in Schedule 1 at the passage of CEPA 1999.
   
    
3. CEPA 1988
   Substances for which an assessment was conducted in accordance with the criteria set out in s.11 of CEPA 1988 to determine whether or not they were toxic or capable of becoming toxic. In respect of these substances, a determination of "toxic" under s.11 of CEPA 1988 was made, and the Ministers of Environment and Health recommended their addition to the List of Toxic Substances in Schedule 1 of CEPA 1988.
